1. General:

Picsmela is committed to protecting your privacy when you visit www.picsmela.com or use its services ("Services") as further outlined in this policy. As a condition of using the Services of Picsmela, you agree to provide Picsmela with certain personal information.

This information includes, but not limited to full name, postal address, phone number and email address as well as your computer's unique IP address (if any), and demographic information (e.g., zip code, postal code, hometown, purchase history information and as well as IP addresses that are not unique to your computer).

Please note that nowhere on the Site do we knowingly collect contact information or financial information from children under the age of 18. Please review this privacy policy periodically as we may update it from time to time. Each time you visit www.picsmela.com, use the Services, or provide us with information, you are accepting the practices described in this privacy policy at that time.

You agree that by using the Site you are expressly and affirmatively consenting to our use and disclosure of the information that you provide, and consenting to receive emails, as described below in this privacy policy.

These materials may include but are not limited to newsletters providing you with additional information on how to use the Services and promotional offers for goods and services from Picsmela or third parties.
Use of Demographic Information: Picsmela may use your demographic information to perform business analyses or to tailor the Site and communications to your interests. We may share anonymous, aggregated demographic information with advertisers and other third parties so that they can tailor their advertisements and communications to the appropriate audience. Any time that we are allowed under this privacy policy to share your contact information or financial information, we may also share your demographic information with it.

4. What is the legal basis for Picsmela collecting personal data?

Picsmela may disclose specific contact information when we determine that such disclosure is necessary to comply with the law, to cooperate with or seek assistance from law enforcement, or to protect the interests or safety of Picsmela or other visitors to the site or users of the Services under the the basic framework of such data protection and privacy is laid out by the rights of privacy granted under the Constitution of Bangladesh ('the Constitution'), along with the Information Communication Technology Act 2006 (only available in Bengali ) ('the Technology Act') and the Digital Security Act, 2018 ('the Digital Security Act').

Also, your contact information may be passed on to a third party in the event of a merger, acquisition, consolidation, divestiture, or a bankruptcy of Picsmela.

In addition to any personal information that you might provide when you do things like buy our products and services or create an account with our brands, we may also have access to other information about you if you interact with our brands via social media, or in certain other situations.

Social Media
If you log into your account with any of our brands through a social media site, we will also have access to certain information from that site, such as your name, account information and profile photo, in accordance with the site’s account verification procedures. Also, if you interact with content on our social media profiles (for example, if you “like” or share a post from one of our brand’s Facebook, Twitter, or Instagram accounts), those social media sites may share information about you with us, including your public profile, e-mail address and friend list. If you choose to “like” or share content, information about you may be publicly displayed on the social network, depending on your privacy settings. You should review the Privacy Notice of that social media site and check your privacy settings through that site. The content you choose to upload to our service, including your photos and the information you store in your address book, may include personal information of others. If you choose to share your photographs or other information with someone else through a feature we offer, we will use the personal information you provide (for example, the e-mail address of the recipient) to fulfill your request and for other purposes described in this Privacy Notice. Before you upload and/or share personal information of others through our service, please ensure that you have the consent of such persons to do so.

Other Information Contained in Your Photos
When you upload your photos to our platforms or give us permission to access the photos stored on your device, your photo content may also include related image information such as the time and the place your photo was taken, tags and similar information stored by your image capture device. If you wish to restrict the transfer of image metadata in your individual photos, please adjust the settings on your image capture device.

3) How Are Website Cookies Used?

www.picsmela.com cookies; It uses it to remember the choices you make and to personalize your use of the website/mobile application. This usage includes cookies that save your password and keep your website/mobile application session open all the time, thus saving you the hassle of entering your password more than once in each visit, and cookies that remember and recognize you on subsequent visits to the website/mobile application.

6) How does picsmela protect your personal data?

Personal data shared with picsmela are under the supervision and control of picsmela. In accordance with the provisions of the relevant legislation in force, picsmela undertakes the responsibility as the data controller to establish the necessary organization and to take and adapt the technical measures in order to protect the confidentiality and integrity of the information. Being aware of our obligation in this regard, penetration tests are carried out periodically in accordance with international and national technical standards on data privacy, and we hereby inform you that we always update our data processing policies.

7) Does picsmela share your personal data?

The sharing of personal data of our customers with third parties takes place within the framework of the consent of the customers and as a rule, personal data is not transferred to third parties without the consent of our customers.

However, due to and limited to our legal obligations, personal data is shared with courts and other public institutions. In addition, personal data is transferred to contract third parties in order to provide the services we undertake and to control the quality of the services provided.

Necessary technical and legal measures are taken to prevent violations of rights during data transfer to third parties. However, picsmela is not responsible for any breaches that occur in the risk area of the third party's responsibility, due to the data protection policies of the third party receiving the personal data.

8) Do you have to limit our collection and use of your personal information?

You have choices about how your information is collected and used. You can notify us of your preferences when you create an account with us, and if you would like to review, correct or delete your account information on our Sites and Apps, you can do so by logging in to your account or by contacting us directly. There may be times when we are unable to fulfill your request – for example, if providing access to your personal information would reveal confidential commercial or proprietary information or personal information about someone else (and we cannot separate your data), if we are prohibited by law from disclosing the information, or if we have a legal obligation to retain certain data. We may require additional

9) How do you delete files from your account and personal information?

Only registered users can upload images from users' pc, mobile devices, and social account photo albums during designing the product. User files are archived in their Account ‘My Files’ directory. Users may delete uploaded files from the ‘My Files’ section.

When the user unbinds a social account, at the same time shared social photo album gets disconnected.

Please note – after deleting or unbinding your social media accounts, the user will lose the images from the pending products/design “in progress or in design” products.

10) How do you request to delete or delete by yourself of personal data?

Picsmela only keeps registered users personal infromation.i.e Name, address, Phone number. You may edit, cancel, or delete your Picamela account personal information or data at any time by using the self-service tools available under My Account in Account Settings (you will be required to log in), or by emailing us at support@picsmela.com. These tools are the most efficient way to take these actions.

If you request that your personal information be canceled or deleted from your account, we will comply with your request within 21 days of completing the requisite verification process. A confirmation email will be sent as well.

Your Legal Rights

Your local laws may permit you to request that we:

Provide access to and/or a copy of certain information we hold about you;
Update or rectify information which is out of date or incorrect;
Delete certain information that we are holding about you;
Transfer your information to a third-party provider of services; and/or
Revoke your consent for the processing of your information, to the extent we rely on consent as the legal basis to process your information; and

You may edit, cancel, or delete your Picsmela account information at any time by entering your login credentials using the self-service tools available ( https://picsmela.com/account/login ). .

Information necessary for the purposes of maintaining business records regarding a deleted or cancelled account, including records of credit transactions and account ownership, will be retained in accordance with applicable law. We may decline to process requests that are frivolous/vexatious, would jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by local law. We may also decline aspects of deletion or access requests if we believe doing so would undermine our legitimate use of data for anti-fraud and security purposes.

11) How long does picsmela keep my photos and information? What are my options?

A key benefit of the picsmela offering is the preservation of all of your memories in one simple spot – for free. By default, picsmela will never delete your pictures, unless you instruct us to do so or you delete by own. As a picsmela account holder, you control what is retained in your account and how long your account remains active.

If you delete picsmela photos from your account, they will be removed from your picsmela app and web interface immediately, and we will permanently delete them from our system in the regular course of business.

12) What happens if changes are made to the privacy policy?

Picsmela reserves the right to change the privacy policy, but will notify users of such changes through email and/or by posting a notice on the site. In the event of any material change, this notification will be prior to that change becoming effective. If the change involves the use of a user’s personally identifiable information then the notice to users will contain directions on how users can opt-out of the change.

For any other request please contact our Customer Support. If you request your account to be canceled or deleted, we will satisfy your request within 21 days.
